Site access et aux services

PlaneteHeberg s'efforce de maintenir l'accessibilite de ses services 24h/24 et 7j/7, sans toutefois pouvoir le garantir. Interruptions peuvent out ofvenir pour des raisons de maintenance, de mise a jour ou pour des motifs techniques independants de notre volonte.

L'utilisateur reconnait les caracteristiques et limits d'Internet, notamment en termes de fiabilite des transmissions et de performances variables selon les networkx.

Contenus interdits

L'utilisateur s'engage a ne pas heberger ou diffuser via nos services :

• Contenus portant atteinte aux droits de propriete intellectuelle
• Contenus a caractere injurieux, diffamatoire, discriminatoire ou haineux
• Contenus illicites ou incitant a commettre des actes illegaux
• Envois massives de courriers non sollicites (spam)

PlaneteHeberg se reserve le droit de suspendre ou terminate tout service hebergeant des contenus non conformes, sans prereviews ni indemnite.

Inscription et compte client

La creation d'un compte client implique l'acceptation des presentes conditions. Le client s'engage a fournir des informations exactes et a les maintenir a jour.

PlaneteHeberg se reserve le droit de demander des justificatifs d'identite (carte d'identite, justificatif de domicile) anytime. La fourniture d'informations fausses ou incompletes peut entrainer la suspension instant des services.

Les mineurs peuvent ouvrir un compte sous reserve de l'accord explicite de leurs responsables legaux.

Tarifs et paiement

Les prix sont indiques en euros TTC out of le site. PlaneteHeberg se reserve le droit de modifier ses tarifs, les nouveaux prix s'appliquant aux nouvelles orders et renouvellements.

Cycle de facturation :

• Generation de la facture : 10 days avant l'echeance
• Rappel de paiement : 5 days avant l'echeance
• Suspension du service : 1 jour apres l'echeance en cas d'impaye
• Suppression definitive : 7 days apres l'echeance

Right of withdrawal and refunds

Consumer customers have, where the right of withdrawal applies, a fourteen-day statutory period to exercise that right under the French Consumer Code, using any means that establishes the date of the request (online form, email or postal mail).

In addition to this statutory right, PlaneteHeberg may offer a seven-day commercial refund guarantee on certain offers, as stated at checkout. This commercial guarantee does not limit the consumer's statutory rights.

Where withdrawal is legally excluded, only any commercial guarantees announced at checkout apply. Refunds may be issued as account credit, except where mandatory law requires otherwise.

Exclusions: Domain names are neither refundable nor exchangeable under any circumstances. No refund is granted for misuse of the service or suspension for breach of the terms of use.

Safeguard measures and emergency maintenance

PlaneteHeberg reserves the right to suspend, limit, restart or temporarily interrupt all or part of the services when necessary to ensure the security, stability or integrity of its infrastructure, in particular in case of thermal risk, power overload, cooling failure, datacenter incident, emergency maintenance, hardware risk or threat of data loss.

Where possible, PlaneteHeberg informs customers in advance. When urgency does not allow prior notice, information is communicated as soon as possible via the status page, client area or any usual channel.

These justified interruptions do not automatically entitle customers to compensation. Any applicable credits are exclusively those provided by the SLA or the specific terms of the offer.

Availability and service level agreement (SLA)

The commitment varies by offer: 99.5% or best effort for entry-level offers; 99.9% for standard offers (VPS, pro hosting, standard dedicated servers); 99.95% or 99.99% for premium offers when the architecture allows. The applicable level is stated on the product page or order.

Excluded from the SLA calculation:

• scheduled maintenance and emergency maintenance / safeguard measures;
• interruptions attributable to the customer;
• thermal risk, cooling, power, datacenter or upstream network when the intervention protects the infrastructure;
• duly established force majeure.

An SLA outage is a total interruption of the relevant service, directly attributable to PlaneteHeberg infrastructure and recorded by PlaneteHeberg monitoring systems. Slowdowns, partial degradation, application errors, customer configuration, saturation of allocated resources or non-reproducible incidents do not constitute an SLA outage, unless a specific agreement states otherwise.

Compensation and SLA credits

No direct financial compensation is due by default. SLA credits may be applied automatically when PlaneteHeberg monitoring systems record, at period end, availability below the contractual target for eligible offers.

Applicable scale for offers with a 99.9% commitment, unless more favourable specific terms apply:

• availability ≥ contractual target: no credit;
• < target and ≥ 99.0%: 5% of the period price (excl. VAT);
• < 99.0% and ≥ 95.0%: 15%;
• < 95.0%: 30% (capped at the period amount).

Credits are issued as account credit, with no cash refund. Excluded: domains, one-off services, free services, indirect damages.

Heatwaves, climate events and force majeure

In case of intense heat creating a real thermal risk to the infrastructure, PlaneteHeberg may carry out a temporary, targeted suspension as a safeguard measure to preserve hardware integrity, security and hosted data.

An ordinary heatwave is not automatically force majeure. A weather alert alone does not justify a refund if the service remains compliant.

Documented, proportionate safeguard shutdowns are excluded from the SLA calculation. Force majeure (French Civil Code art. 1218) may only be invoked for exceptional, unforeseeable and irresistible events.

Liabilitys

• PlaneteHeberg ne garantit pas l'absence d'interruptions ou d'erreurs
• PlaneteHeberg met en place des meout ofes de security proportionnees mais ne peut garantir une security absolue

Consumer mediation

In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumer customers may use a consumer mediator free of charge to seek an amicable resolution of a dispute, after a prior written complaint to PlaneteHeberg has remained unsuccessful.

Designated consumer mediator: up-to-date contact details are published on the legal information page at planeteheberg.com and in the client area.

Applicable law and jurisdiction

These terms are governed by French law. In the event of a dispute, the customer is invited to contact PlaneteHeberg first to seek an amicable solution.

For consumer customers, the provisions on consumer mediation apply as set out in the preceding section.

Failing amicable resolution, and except where mandatory law provides otherwise, the courts of Paris shall have exclusive jurisdiction.
